Kentucky Friend Chicken Canada Company (“KFC Canada”), and its affiliates TB Canada Company (“Taco Bell Canada”) and PH Canada Company (“Pizza Hut Canada”) (collectively, “we”, “us” or “our” ) work with our Pizza Hut, Taco Bell, KFC and KFC Fresh franchisees across Canada to run great restaurants.
KFC Canada collects, uses and discloses personally identifiable information (“Personal Information”) about our customers in order to provide automated and centralized order processing and delivery dispatch solutions so that we, along with our franchisees, can deliver exceptional service to our customers. We also use Personal Information to inform customers about our products and services, including providing special offers and incentives. Finally, we collect, use and disclose personal information respecting applicants for potential employment or franchise opportunities with KFC Canada or its affiliates.
What is Personal Information?
Personal Information is any information that identifies you as an individual, such as your name, address, telephone number and other information, such as order history, that may be tied to your identity.
Personal Information does not include information respecting a business organization, or the name, title or business address or telephone number of an employee of an organization.
Personal Information does not include aggregated or anonymized information that does not identify you as an individual.
What Personal Information do we collect?
Information collected from Customers
Typically, when a customer contacts us, either by telephone or through our website, we collect certain Personal Information, including the customer’s name, address, phone numbers, credit card number (if that is how they choose to pay), email address (if the customer orders through our site), and any comments that a customer may provide to us. We also record the customer’s order, and over time, develop and retain an order history for returning customers. KFC Canada shares this information with our affiliated companies, and, as necessary to fulfill your order, provides your Personal Information to the independent franchisee that serves you. The information we provide to such franchisees is governed by their Personal Information practices and privacy practices. You should consult with the franchisee who serves you to find out how and why they use and disclose your Personal Information.
Information Collected from Potential Franchisee
Typically, when a potential franchisee contacts us we collect the potential franchisee's names, addresses, phone numbers, email address as well as financial information and work and education background and history.
Information Collected from Applicants for Employment
With respect to potential employees, we collect only that information that is reasonably necessary to assess an individual's application for and suitability for employment and to administer our employees. The information that is collected includes names, addresses, phone numbers, email address, bank accounts as well as information regarding performance, work/education background and history and such information contained in a résumé or that is obtained from references.
Why do we collect Personal Information?
Customer Personal Information
You hereby consent to the collection and use of your Personal Information (including delivery address, email, and past order history) for the following purposes:
- to fulfill orders;
- to anticipate order preferences when you contact us again;
- to evaluate and respond to requests, inquiries and applications;
- to comply with and enforce applicable legal requirements or audit requirements; and
- to provide you with requested services.
If you tell us that you do not wish us to keep your Personal Information, we will destroy it, subject to retention through our automatic backup procedures and in connection with applicable record retention requirements. At present, our systems cannot track these types of requests beyond destruction of Personal Information. As such, if you order from us again, we will collect your Personal Information upon submission of the new order and it will not be automatically destroyed unless you “OPT OUT” when placing each new order. Refer to the section below entitled “How can I access and update my Personal Information?” for instructions on how to notify us of your preferences. In that case, you will need to provide Personal Information each time that you contact us to place an order.
Unless you otherwise notify us, and as permitted by law, you hereby consent to the use of your Personal Information for marketing purposes, such as to contact you (whether by email, telephone, direct mail, or another medium of communication) about:
- promotions or contests;
- new products or product promotions;
- special offers;
- asking for feedback on new products;
- asking for feedback on your dining experience and our customer service; and
- responding to your comments or concerns.
You may opt out at any time from the receipt of marketing communications. Please, refer to the section below entitled “How can I access and update my Personal Information?”
We may disclose your Personal Information to parties to a prospective or completed business transaction, such as a reorganization or an acquisition of our business, for the limited purpose of assessing or completing such a transaction.
We may also use and disclose your Personal Information as may be required or permitted by law.
We will not collect, use or disclose your Personal Information for any other purpose without notifying you and obtaining your additional consent.
Personal Information of Franchisee Applicants
We use Personal Information of franchisee applicants only for the purpose of determining whether or not to grant a franchise to the applicant. If the applicant is successful we will also retain and use the Personal Information collected in the course of assessing the application for a franchise for use in connection with the franchise agreement. We may retain applicant information for a period of twelve months from the date of application for the purpose of assessing an individual's suitability for other franchise opportunities with our organization, following which the information is destroyed by secure means.
Applicants for Employment Personal Information
We use Personal Information of applicants for employment only for the purpose of assessing suitability for employment. If the applicant is successful we will also retain and use the Personal Information collected in the course of assessing the application for employment. We may retain an applicant’s Personal Information for a period of twelve months from the date of application for the purpose of assessing an individual's suitability for other employment opportunities with our organization. Applicant Personal Information is destroyed after twelve months from the date of application (subject to retention in connection with automatic backup procedures and applicable record retention requirements) if no employment with our organization materializes in that time period. Disposal is executed by shredding or another secure disposal mechanism.
How do we safeguard Personal Information?
We retain Personal Information for only so long as we have a legal or reasonable business reason to retain it. Except where prohibited by law, when Personal Information is no longer required for the purposes for which it has been collected, such Personal Information will be destroyed, subject to retention in accordance with our automatic backup procedures and in connection with applicable record retention requirements.
We maintain administrative, technical, and physical safeguards designed and intended to protect your Personal Information against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use. Personal information collected by us, whether in electronic form or paper form, is protected by security measures appropriate to the sensitivity of the information.
We evaluate our equipment and security procedures regularly and modify them as necessary. Despite these safeguards, due to inherent uncertainty in the use of the Internet and information systems and the potential for unlawful attacks by third parties, we cannot guarantee that the use of our systems, websites, or applications will be completely safe or secure.
Personal Information may be stored and processed outside of Canada, including the United States. As such, Personal Information may be accessed by foreign governmental authorities and otherwise in accordance with the laws applicable in the jurisdiction in which it is stored.
How can I access and update my Personal Information?
We make efforts to ensure that the Personal Information we use and keep is accurate, complete and up-to-date; however, we necessarily rely on our customers to provide us with accurate and current information. You may request to review and/or correct your Personal Information by contacting the KFC Canada Customer Service hotline at 1-866-364-0862 and submitting your request to review and/or correct this information. All requests will be dealt with within 30 days of receipt of your call.

- Keep your Personal Information for future service purposes;
